Legal departments today face multiple daunting challenges—including
rising volumes and complexity of legal work and pressure to reduce costs. To
manage these challenges, more organizations are establishing legal operations
teams. Understanding what legal operations does—and how—can help legal departments to efficiently deliver measurable business results and their counsel to
    better serve their clients.

What Does Legal Operations Do? Five Strategic Activities

Analysis of legal operations frameworks—as defined by the Corporate Legal
Operations Consortium and the Association of Corporate Counsel—in this study
indicates that the best legal operations teams excel at five strategic activities:
    (1) vendor, (2) risk, (3) knowledge, (4) finance/budgeting, and (5) technology
    management.

How Does Legal Operations Work? Five Enabling Levers

Five levers enable legal operations teams to perform the strategic activities
they’re responsible for: (1) data analytics, (2) technology, (3) strategic planning,
    (4) intra- and inter-functional collaboration, and (5) process standardization and
    optimization.

    Generating Measurable Business Results

Organizations that set up an effective legal operations team can reap
multiple valuable benefits—including higher quality of legal work, improved
resource efficiency, an improved legal risk profile, and better talent retention.

Best Practices and Implications for Legal Ecosystem Players

The advent of legal operations teams will exert a significant impact on different
players in the legal ecosystem. Legal departments will need to determine their
strategy. Best practices identified in this study can help. As the customer side is
changing, firms, new providers and law schools have to adapt to exploit these
opportunities and avoid loss of business.

awStats provides quantitative insights into court decisions from the Bundesgerichtshof – Federal Court of Justice (BGH), the Federal Court of Justice in Germany. Using Watson Web Services and approaches from Sentiment Analysis (SA), we can automatically classify the revision outcome and offer statistics on judges, senates, previous instances etc. via faceted search. These statistics are accessible through a open web interface to aid law professionals. With a clear focus on interpretability, users can not only explore statistics, but can also understand, which sentences in the decision are responsible for the machine’s decision; links to the original texts provide more context. This is the first largescale application of Machine Learning (ML) based Natural Language Processing (NLP) for German in the analysis of ordinary court decisions in Germany that we are aware of. We have analyzed over 50,000 court decisions and extracted the outcomes and relevant entities. The modular architecture of the application allows continuous improvements of the ML model as more annotations become available over time. The tool can provide a critical foundation for further quantitative research in the legal domain and can be used as a proof-of-concept for similar efforts.

    AT A GLANCE

Powerful forces are reshaping the corporate legal-advice market, including price pressure from clients and the digitization of legal data. Legal-technology solutions can help law firms succeed in this new era, but only if they understand the tech landscape and redefine key elements of their business model.

    Mapping the Legal-Tech Landscape

The legal-tech landscape comprises three solution categories: enabler technologies facilitating the digitization of legal data, support-process solutions infusing new efficiencies into case-management and back-office work, and substantive law solutions supporting or replacing lawyers in executing core legal tasks in transactions and litigation cases.

    Legal Tech’s Impact—Today and Tomorrow

While legal tech began with the automation of standard legal tasks, it’s moving toward supporting more bespoke, specialized activities performed by lawyers. It’s also capitalizing on opportunities presented by big data analytics, helping lawyers capture valuable insights from large data sets.

    Next Steps for Law Firms

To safeguard their market share and profitability in a market transformed by legal tech, law firms must rethink two elements of their business model: their value proposition (including their service offerings and revenue model) and their operating model (including their cost structure and organizational structure). The right decision for each element will differ for “big law” and “small law” firms that focus on standardized cases.

Legal Tech’s Impact on Individual Roles and Legal Education

In the future, the business of law will require fewer general support staff members, junior lawyers, and generalists—and more legal technicians and project managers. Accordingly, law schools may need to offer courses on legal tech and case-management processes. Law firms can offer on-the-job training to help lawyers leverage legal-tech solutions and executive education programs focused on legal-tech literacy.
