So far I have tried to save the PD-Italy photos in the mass deletion request, I deleted the ones that hardly could be saved (basically those that looked like the model posed by order of the photographer). Someone want to delete some photos from Mondadori agency I uploaded, like Adrien Cayla-Legrand — DS — The Day of the Jackal (1973).jpg and Harrison Ford — Raiders of the Lost Ark.jpg. I've read (and I guess quite understood) your analysis on the Italian law above and your further today comments on other deletion requests. So I would like to know your comment on this one : why should a photography by Angelo Deligio should be deleted from Commons and others by Mario De Biasi (or others) be kept ? Is it an administrator's choice ? We had recently a discussion at COM:BI#PD-Italy upon the traduction of "scattata in Italia" and users seems to agree that Italian law may not apply to works made outside Italy (but I might be wrong). Anyway one user is asking if pictures made outside Italy before 1976 by Italian citizens ([1], [2]) are eligible for Commons. Thanks for your reply. Commons requires that images be free in the country of origin and in the United States. "Country of origin" usually means the country in which the image was first published, so as a general rule, Italian law should be applied only to those images that were first published in Italy. Images taken by Italian photographers outside of Italy and images taken in Italy but first published elsewhere will not, generally, have Italian law applied to them. There is a significant exception, however. If an image is published in multiple countries within thirty days, then the country of origin is the country with the shortest copyright term, see Berne Convention#Country of origin. . Jim . . . Stamps in Switzerland
Are you sure that this applies to stamps? I think it depends upon the legal definition of "means of payment". By the way, there's a disclaimer on the English translation: English is not an official language of the Swiss Confederation. This translation is provided for information purposes only and has no legal force - in the official languages it's "Zahlungsmittel" (German), "les moyens de paiement" (French), and "i mezzi di pagamento" (Italian). Also, since several years, the Swiss Post is no longer a government agency, as it used to be, but an officially "privatized", though fully state-owned limited company. So, the suggested template {{PD-Switzerland-official}} doesn't seem to fit, as the Swiss Post isn't able to issue "official" material. Hi again; I have now looked up the matter in one of the leading Swiss law commentaries (Barrelet/Egloff: Das neue Urheberrecht, Bern 2008, ISBN 978-3-7272-9563-8), and there it is clearly stated on page 33 that the "means of payment" exemption from copyright does not apply to stamps. I'm quoting: "Hingegen geniessen Briefmarken Urheberrechtsschutz, da sie keine Zahlungsmittel sind und auch sonst unter keine Ausnahmebestimmung fallen". My translation: On the other hand, stamps enjoy copyright protection, because they are not means of payment, and furthermore don't fall under another exemption clause. I'm looking at the source article, and the closest I can find that matches this image is Supplementary Figure 5e[3] for the left part of the commons image. What is the origin of the right part of the commons image? Having them separate would improve reusability. But more importantly, Figure 5e is simulated, whereas 5d is actual experimental. I suppose there is some reason you deleted this file.
Some years ago I spent several months finding photos of oldtimers and uploading them to commons. I included clickable links with precise descriptions of sources and extensive categorization. It seems you followed that link, uploaded an identical version and renamed it with extension .png, included character for character the image description I wrote, then deleted my original contribution, as if I never existed. Not cool! ----
- I have no problems restoring that file, but I see no need for that. Commons is not a cemetery, it is a database of encyclopedic images. I must tell that I greatly appreciate your image work. Undeletion
I might. Could you kindly open an undeletion request and indicate why you ask for the undeletion? So far I have tried to save the PD-Italy photos in the mass deletion request, I deleted the ones that hardly could be saved (basically those that looked like the model posed by order of the photographer).
