Regulation of Artificial Intelligence: An Urgent Need for Brazil. A recent survey I conducted through IDEIA shows a clear trend: over 70% of Brazilians believe it is essential to establish regulations for artificial intelligence (AI). This survey, reflecting growing awareness of AI's impacts, underscores the urgent need for a robust and effective regulatory framework to ensure the ethical and safe use of this emerging technology. I want to share with you some crucial factors from this research: 1. Protection of User Rights: AI regulation helps protect individual rights, ensuring that their information is used ethically and responsibly. 2. Safe Innovation: Clear standards encourage innovation within safe limits, promoting the development of AI solutions that benefit society without compromising security. 3. Bias Reduction: Establishing rigorous criteria for AI development and implementation can help reduce biases, promoting fairness and equity in automated decisions. An international example of such regulation is the European Union. We can learn a lot from the European Union, which is at the forefront of creating a comprehensive regulatory framework for AI. The EU AI Act sets strict criteria for identifying and mitigating risks associated with complex systems, requiring developers to meet stringent safeguards before bringing their technologies to market. This type of regulation is essential to ensure that AI models are safe and ethical. So, what is the best path for Brazil? I believe that in Brazil, following examples of international legislation can be an effective way to ensure that AI use is beneficial and safe. It is essential for policymakers, companies, and civil society to work together to develop a regulatory framework that reflects Brazilian needs and values. The IDEIA survey, coordinated by me, highlights a clear consensus: AI regulation is necessary not only to mitigate risks but also to foster a responsible innovation environment. Implementing well-defined standards can ensure that AI positively contributes to society, promoting technological advances that respect and protect individual rights. A Major Milestone in Technology in Brazil and… in My Career 🚀 I am thrilled to share a significant achievement: I led the delivery of the FIRST PUBLIC TOKENIZED COMMERCIAL INVOICE (Nota comercial) in Brazil at Liqi Digital Assets! 🎉 When I joined Liqi just a few months ago, after three years deeply involved in the blockchain market, my goal was clear: to develop projects that drive innovation and transform the Brazilian financial market. AI regulation is being discussed in the Brazilian Congress. However, most of the discussion (and the text of the bill that I had the opportunity to read) concentrates on mitigating the potential risks of AI without the country even having a strong AI ecosystem. Why is this happening? In policy design, there are two main approaches that are often used: the 𝐜𝐨𝐬𝐭-𝐛𝐞𝐧𝐞𝐟𝐢𝐭 𝐚𝐧𝐚𝐥𝐲𝐬𝐢𝐬 (𝐂𝐁𝐀) and the 𝐩𝐫𝐞𝐜𝐚𝐮𝐭𝐢𝐨𝐧𝐚𝐫𝐲 𝐩𝐫𝐢𝐧𝐜𝐢𝐩𝐥𝐞 (𝐏𝐏). CBA evaluates the pros and cons of regulatory actions to maximize society's benefits, emphasizing efficiency and optimal resource use. In contrast, PP advocates for preventive measures, prioritizing risk minimization even at the expense of potential benefits or innovation. Considering this perspective, the EU AI Act and the current Brazilian AI regulation seem to focus more on PP by explicitly defining AI and AI actions and regulating what AI can and cannot do. Conversely, the Blueprint for an AI Bill of Rights in the USA and South Korea's National Strategy for AI seem to focus more on CBA. I attached to this post page 24 of South Korea's National Strategy for AI, where they propose regulatory innovations to foster the growth of an AI-based economy and keep up with the advances that are yet to come (full document available here https://lnkd.in/dHq6dCVe). This approach not only tries to accelerate the spread of new AI industries and technologies (by allowing everything in principle) but also attempts to establish a future-oriented legal system that can adapt to the rapid changes of the AI era. And it appears to be working. South Korea set a goal to move from 26th (in 2019) to 5th (by 2030) in the IMD Digital Competitiveness Ranking (https://lnkd.in/dTFMaZ9D). We are in 2024, and the country is already in 6th place. PP and CBA are both important approaches. However, I am truly concerned about many low- and middle-income countries, such as Brazil and others in the Global South, adopting PP to regulate AI. Adopting the PP right now could lead to the premature "death" of an emerging industry that holds immense promise. 𝐍𝐚𝐭𝐢𝐨𝐧𝐬 𝐥𝐢𝐤𝐞 𝐁𝐫𝐚𝐳𝐢𝐥 𝐜𝐚𝐧𝐧𝐨𝐭 𝐚𝐟𝐟𝐨𝐫𝐝 𝐭𝐡𝐞 𝐥𝐮𝐱𝐮𝐫𝐲 𝐨𝐟 𝐬𝐮𝐟𝐟𝐨𝐜𝐚𝐭𝐢𝐧𝐠 𝐢𝐧𝐧𝐨𝐯𝐚𝐭𝐢𝐨𝐧 𝐚𝐧𝐝 𝐭𝐡𝐞 𝐞𝐬𝐭𝐚𝐛𝐥𝐢𝐬𝐡𝐦𝐞𝐧𝐭 𝐨𝐟 𝐚 𝐬𝐭𝐫𝐨𝐧𝐠 𝐀𝐈 𝐢𝐧𝐝𝐮𝐬𝐭𝐫𝐲, which are critical for addressing systemic and challenging problems, especially in low-resource environments where AI can have the most significant impact. I believe AI policies in low- and middle-income countries should strongly focus on creating an enabling environment where innovation can flourish and on enhancing the imagination and willingness of individuals and industries to tackle societal challenges. The Devil is in the details. [Update: Check the commentaries at: https://lnkd.in/ducyqdic ] [em português em outro post] My commentaries on the freshly issued regulation on #Platforms for #Betting and #Gambling Operators in #Brazil is a little bit delayed, but for 2 very good reasons. First is that I took a few days off (2!), but mostly because this apparently technical norm issued by the Gaming Authority ("SPA") is actually a must-read complement to the Brazilian Betting and Gambling Law itself. The regulation sets clear(er) two very disputed items: the definition of "online games" and the distribution of AML responsabilities. On the first side, the regulation indicates an overall authorization of fixed jackpots slots, with a few important requirements that mix technical specifics with consumer protection (information on the possible prizes M U S T be evidenced to the gambler BEFOREHANDED). Crash games and progressive jackpots slots will have a harder time - Operators that insist in adopting those will jeopardize the very certification of their Platforms. When we think of the new requirements and add the OVERALL prohibition of bonuses... one can only expect a radical UX revolution in the Brazilian gambling market. Last, but certainly not least: Operators M U S T guarantee their #KYC duties in-house as it will be a requirement for platform certification. The new SPA regulation indicates that AML duties might not be provided outside of the platform and SPECIALLY that operators will answer for their own #AML duties which is not to be confounded with payment providers AML duties. Also, completely outside third parties that offer KYC solutions will need to be fully integrated with Platforms for these to be certified. Our commentaries will be out tomorrow.

Last week, I had the opportunity to spend a couple of days in the Bay Area, participating in some fantastic events, including Brazil at Silicon Valley. 💥 Unsurprisingly, AI remains the "talk of the town," and has been for quite some time now. 🎯 I synthesized six initial and preliminary insights into AI, both in general and within the realm of finance.
