Topic 1B – Alternative Dispute Resolution and Enforcement of Judgment

Q1. Alternative dispute resolution is a collective term for the methods that parties can use
to settle their disputes without resorting to court proceedings. Explain the types of
alternative dispute resolution in Malaysia.

Q2. Mediation is a voluntary, out of court, solution driven and party orientated method of
dispute resolution. Mediation may be carried out between two or more parties by way
of seeking the assistance of a trained and impartial third party, the Mediator, to assist
the parties to negotiate a mutually beneficial and acceptable agreement. Describe the
mediation stated under the AIAC Mediation Rules and prescribed schedules of fees
for domestic and international mediation

Q3. Arbitration proceedings in Malaysia are governed by the Arbitration Act 2005. Define
the meaning of arbitration.
