This user-made photograph features beverage cans that may or may not pass U.S. copyright law's threshold of originality. Discussion at Wikipedia:Deletion review/Log/2014 June 6 concluded that this should be discussed here. Sandstein 06:55, 14 June 2014 (UTC)
- Commons:Commons:Deletion requests/File:XTC energy drink.jpg concluded that the can design is not copyrightable. The local version is not in use and should be deleted per WP:CSD#F8. January (talk) 18:09, 14 June 2014 (UTC)
- Some notes (partially repeating things I wrote on Commons):
- As User:Elvey noted, utilitarian objects are ineligible for copyright in some countries such as the United States. Commons has some information about this at c:COM:UA. A can is utilitarian.
- If you affix a non-utilitarian thing to a utilitarian thing, then this does not cancel any copyright in the non-utilitarian thing. For example, a computer hard disk is utilitarian, but by storing a file on the hard disk, you do not automatically cancel any copyright which rests in the file. In this case, the print on the can isn't utilitarian. However, the print seems to be below the threshold of originality anyway.
- If the source country is the United States as suggested on Commons, then the file was rightfully kept on Commons. In that case, there is no need for us to keep the image here, see WP:CSD#F8. Was the source country correctly identified? There seems to be some text on the cans which is only partially visible. On the green can, this text is in Portuguese (I think) and French. On the blue one, the text is in Spanish. Measurements seem to be in metric units. --Stefan2 (talk) 20:10, 14 June 2014 (UTC)
- Text doesn't pass the bar for originality as far as I can see--it's just a font. Can can't be subject to copyright. No clues on the international implications on commmons, but we can/should have access to this image on en--as long as commons keeps it we can use that, and if they delete it, we can recreate it. Not a copyright lawyer, so I could have something wrong, but I'm fairly certain I'm right. Hobit (talk) 16:27, 15 June 2014 (UTC)
- This Commons discussion thought the drink was US (Missouri) but is that right? It doesn't look like it to me.[1] And I can imagine another discussion on Commons arguing that even typefaces can be arranged in a creative way. So, I don't trust it would necessarily be kept on Commons if challenged again. It seems to me a WP non-free use claim would be a strong one if someone wrote an article and created a NFUR. Otherwise I don't see it worth keeping it just in case. Thincat (talk) 16:48, 16 June 2014 (UTC)
