  • Image is supposedly taken from the FCPS website, but I could not find any copy of the image on that website and I have never known FCPS to license any of their media freely. I suspect that this file was indeed taken from somewhere on the FCPS website, but that it is un-free.   • Complainer is clearly not well-versed in Wikipedia policy, and appears to be a troublemaker. There have been several erroneous Wikipedia policy violation accusations made by said accuser, that are in no way or shape true. The most telling example is the accuser claiming this image was licensed under "Fair Use" when clear as day the image is licensed as "Non-free media information and use rationale – non-free logo for Northwestern High School (Hyattsville, Maryland)." I'm aware that's not the technical term, but at the end of the day, the image is licensed as NON-FREE MEDIA and since the Wildcat image is as "official" an image as one will find when associated with the school in question (you can find the Wildcat throughout the schools' website), it can be permitted for use on Wikipedia using the appropriate non-free use rationale licensing. I've had numerous, knowledgeable editors review the same image, and not one of them has (a) claimed the image violated image use on Wikipedia or (b) tagged the file for deletion. Conversely, the editor who has made the accusation found a random, self-made image that is apparently being used on a Northwestern High School PTSA Facebook page, which is not an official page overseen by Northwestern High School. The logo cannot be found on anything officially representing the school. Add to that, the user has tagged the image as an "official logo" being used by Northwestern, and that is simply untrue. The irony in this whole fiasco is that the policy violations I'm being accused of, are violations the originating accuser is guilty of themselves! --Khemistry (talk) 05:18, 9 July 2014 (UTC)[reply]
  • I apologize for sending the nominator to the wrong forum – since nobodies claiming that this is non-free content it should have gone to WP:NFCR instead. Regardless, since this logo has been replaced with another image it will soon be deleted "automatically" as non-free content that is not in use. However, Maryland Pride (talk · contribs) appears to contest the use of a new image. If this dispute continues I think taking it to WP:NFCR for a more drawn out discussion may be the only option. On the substance of the issue, since the logo appears to be mostly user created, I agree that the file probably does fail WP:NFCC. CT Cooper · talk 16:57, 9 July 2014 (UTC)[reply]

  • I thought that any public artwork installed before 1978 without a copyright notice is also in the public domain, just as it is on Commons.   • Keep: Even ignoring the copyright notice issue, that it was installed in 1950 means to be copyrighted still it would have to have been renewed at some point. An inspection of the Copyright Office records for any entries under the name "Duncan Phyfe" or for works titled "Chair of Thomasville" returned zero results.   • The main thing I might advise Dennis and others to do in the future is include a standard statement of an attempt to find evidence of copyright (e.g., "I checked all plaques and visible markings on the statute and its pedestal where it was published, and discovered that it was published in (YEAR), but did not include the required copyright formalities. A photograph of the pedestal/plaque has been uploaded to (FILENAME)."). Might seem a bit silly to have to go through all those hoops, but as the old saying goes, "an ounce of prevention..." By the way, Mark, the case study you link to below is particularly valuable. I'll be honest, I have avoided photography of all public art, believing that the US freedom of panorama law covered this, but I did not realize that copyright before 1978 had to be established and registered with public art as well as photos.   • The plaque was uploaded at the same time, it was tagged by the same person for upload at Commons, the only place that those images are currently used is User:Dennis Brown/Articles/The Chair of Thomasville, which clearly says that the work was erected in 1950. I had this same issue on Commons with Dinah the Pink Dinosaur but it was because the editor didn't understand the policy [1]. I can't help but think that the spirit of WP:BEFORE applies. My first ping was a notification to come here. I can handle policy fine, but adding a bunch of extra steps make this very unfriendly for new users and isn't supported by policy.   • I don't think there is any problem of good faith, I trust that, but the methods might be a bit rushed. I could see half of new editors (<100 edits) just getting discouraged and accepting deletion, not even knowing the policy, just knowing that the Wikipedia deleted their photo.
