- Keep According to the Polish cppygiht law 1994 all photos PUBLISHED on the territory of Poland before 1994 without clear copyright notice on photo are copyfree.
PUBLISHED – it doesn’t mean only PRINTWD, but is a definitione of Berne Convention Article 3 (3)
„The expression "published works" means works published with the consent of their authors, whatever may be the means of manufacture of the copies, provided that the availability of such copies has been such as to satisfy the reasonable requirements of the public, having regard to the nature of the work.”
So it is not neccessary in the Polish copyrigt law to print a photo for making it published. All photos from state public archives or collecting institutions made before 1994 and presented in public without any copyright reservations have a presumtion of PD. This photo is en:Stanisław Radkiewicz (1909-1987) for obvious reason published before 1994 in presented in public by state institution Institute of National Remembrance Archive without any copyright restictions.
