The above link does not specify any such restriction. It does indeed expressly permit 'fair use' reproduction, but it also states that the Library of Congress believes the photo to be in the public domain. The only restriction they place is on what one may do with the photograph as a physical object, not on what one may do with the image.

The only copyright issue that the link seems to raise is that Bruce Kellner may dispute the Library's determination. Edit: It looks like this issue has been gone over already. If you look at the image's page you will see a box that says much the same thing. You will also see a link to , with 430 photos from the same collection! [tnjman - start] My thoughts are that, since the purpose of Wiki-type articles is to be "informative and educational," similar to the purpose of a traditional hardcopy encyclopedia, then the use of such images falls into the category of "fair use."

My understanding of "fair use" is that, in general, it involves cases where an image is used as an educational tool or as a reference to further describe a topic, as long as such use is not intended for financial gain; and as long as any existing copyright attributions, if so required, are listed along with the image.

Regarding "public domain" images: any images which are classified as belonging to the public domain may be freely used, without requirements for copyright attibutions and without restrictions on use of said images.
